Bloomberg Law interviewed Finnegan attorney Maximilienne Giannelli to discuss Title Source, Inc. v. HouseCanary, Inc., a trade secrets case that will test how damages are calculated in litigation.
In 2016, Title Source (now known as Amrock) sued HouseCanary, accusing the company of not upholding its end of a contract for developing an app projected to make a major impact in the real estate industry. The Texas jury, however, found that Amrock stole trade secrets from HouseCanary to develop copycat software and awarded HouseCanary nearly $740 million in damages and attorneys fees—one of the largest awards in a trade secrets case. Amrock is appealing the decision, and practitioners are weighing in on the size of the award and how the decision may affect relationships between startups and established companies.
Max spoke to the principle of unjust enrichment and the difficulty in quantifying it. She said, “I do think there is a sense that some of these very large unjust enrichment theories may have gotten a bit out of hand, and the focus should be on having a more rigorous analysis to support those calculations. The main challenge will be the expert’s assumptions when putting together his calculations for unjust enrichment and whether those were sufficiently grounded or not.”
