Internet Trademark Case Summaries
Hasbro, Inc. v. Internet Entertainment Group, Ltd.
40 U.S.P.Q.2d 1479 (W.D. Wash. 1996)
The court found that defendants’ use of the domain name “candyland.com” for an Internet site offering sexually explicit content diluted by tarnishment the famous trademark CANDYLAND for board games under the FTDA. The court ordered defendants to immediately remove all content from the “candyland.com” Internet site, but allowed them to post a “referral notice” for 90 days providing their new Internet location without using a hyperlink. At the end of the 90-day referral period, defendants were enjoined from using the “candyland.com” domain name.
