We may soon witness the death of software and business-method patents, and we need to plan for it. The Federal Circuit has made the eligibility of method claims in these patents much more difficult, and the USPTO has invented more obstacles, some even extending to apparatus claims. Of course, the Supreme Court’s decision in Bilski v. Kappos, will control, but few expect a return to the pre-Bilski days. Moreover, any claims that survive the §101 gauntlet will face additional challenges under 35 U.S.C. §112 on the issues of indefiniteness and written description, and 35 U.S.C. §103 on obviousness.
This webinar will examine the current state of the law for business-method and software patents. It will also offer suggestions to shore up existing portfolios, obtain new protection, and position companies for the changing landscape of protection for inventions in this new economy.
