Many observers of the USPTO have commented that the written description requirement for biotechnology inventions seems to be greater than that for other types of inventions. This webinar will review the origins of the seemingly heightened written description requirement for some types of applications. The USPTO’s written description requirements for certain types of claims are also quite specific, and the USPTO has prepared detailed written guidelines to illustrate those requirements. We will provide a summary of some of these specific requirements to assist patent drafters in ensuring compliance. And we will also discuss common types of USPTO claim rejections and the kinds of arguments that might be successful in overcoming them.

This webinar is the third of our Strategic U.S. Patent Series for European Counsel, a series of four webinars covering the latest strategies for successful U.S. patent prosecution, designed specifically for the changing U.S. environment.
