Scott R. Mosko

Scott Mosko practices complex intellectual property litigation. In nearly 30 years as a litigator, he has represented both plaintiffs and defendants in patent and trade secret cases involving a variety of technologies, including medical devices, semiconductors, telecommunications, and the Internet. Mr. Mosko also handles trademark litigation in cases venued in California.
Mr. Mosko has vast experience with N.D. California cases where he has been lead counsel, and has argued or participated in claim construction hearings in each division. He has handled cases assigned to nearly all of the judges and magistrates in N.D. California. Mr. Mosko has argued before the California Supreme Court and represented multiple parties in Section 337 investigations at the U. S. International Trade Commission (ITC).
Mr. Mosko lectures regularly at legal seminars regarding intellectual property litigation. Recently he and the Honorable Ronald M. Whyte co-taught a class in patent litigation at the Santa Clara University Law School. Mr. Mosko served as an adjunct professor at San Jose State University, and has participated in legal presentations offered in Beijing, Shanghai, Hong Kong, and Taiwan.
Highlights
- Successfully defended several entities in an ITC investigation where the administrative law judge and the ITC concluded that the accused products did not infringe the asserted patent.
- Monolithic Power Systems, Inc. v. O2 Micro International Ltd. (N.D. Cal.). Successfully defended Monolithic Power Systems, ASUSTeK, and Asus Computer International in a patent infringement action. Served as lead counsel to ASUSTeK and Asus.
- Successfully defended a manufacturer of blood glucose testing equipment in patent infringement action brought in N.D. California.
- Represented Philips Electronics North America Corporation in S.D. California and E.D. Texas in cases concerning medical imaging systems known as picture archiving and communications systems (PACS).
- Served as lead counsel in a N.D. California case representing patentee involving technology that tracked user movement on websites to identify trends.
- Successfully defended a manufacturer against an infringement suit brought in N.D. California involving a patent that described a way for mobile devices to connect to the Internet. Case included a claim for preliminary injunction and resulted in the court granting summary judgment.
- Insight Development Corp. v. Hewlett-Packard Co. (Fed. Cir.). Successfully defended Hewlett-Packard against a $1.4 billion claim of patent infringement, trade secret misappropriation, breach of contract, and unfair competition regarding printer devices.
- Served as an executive member of the Federal Courts Committee, which advised the California District Court bench on local rules and procedures.
- Served as senior law clerk to the Honorable Robert Rickles of the California Court of Appeals, Fourth Appellate District, 1982-1984.
