Richard Stroup has broad experience in all aspects of intellectual property law, concentrating his present practice primarily on patent litigation and client counseling. He has served as lead counsel on numerous patent cases, before juries, district court judges, and the U.S. International Trade Commission (ITC). He has also served as lead counsel in appeals, patent interferences, reexamination proceedings, patent reissues, and trademark and copyright cases. He has presented cases before arbitrators, magistrates, and mediators.
Mr. Stroup counsels clients on strategic planning in patent and trademark litigation and prosecution, due diligence studies, licensing, and alternative dispute resolution. He actively pursues business resolutions through negotiation and settlement, when such a strategy meets the goals and interests of the client.
Mr. Stroup has served as the practice leader of the firm’s mechanical group, the section leader of the firm’s litigation section, a member of the firm’s coordinating committee, and a member of the firm’s management and compensation committees.
Mr. Stroup’s practice has covered a wide range of technical areas, in mechanical, electrical, chemical, and biotechnical fields. Specific technologies include sports equipment, oil well drilling and logging equipment and systems, medical devices, air-conditioning systems, control systems, compressors, ultrasound systems, cleaning chemicals, farm machinery, rupture disc technology, home appliances, semiconductors, cables, printer cartridges, motors, and semiconductor testing equipment.
Mr. Stroup frequently speaks and writes on topics regarding intellectual property law.
Highlights
- Represented LG Electronics in defense to a patent infringement action in the W.D. Mich.; summary judgments of invalidity or noninfringement were entered and affirmed on appeal.
- Represented York International in a jury trial in the W.D. Wis.; obtained a jury verdict of noninfringement and invalidity in favor of the client and an award of attorney fees. No appeal was taken.
- Represented Halliburton before the ITC; obtained an early dismissal of the investigation.
- Represented LG Electronics before the ITC; the administrative trial judge and the Commission entered a determination in LG’s favor; no appeal was filed.
- Represented Phicom before the ITC; the administrative trial judge and the Commission entered a determination in Phicom’s favor; no appeal was filed.
- Represented the trainer of the Oakland Raiders and his licensee in a jury trial in the Kansas district court; obtained a jury verdict of validity and infringement for the trainer and his licensee. No appeal was taken.
- Represented an individual inventor in a jury trial in the Illinois district court; obtained a jury verdict of validity and infringement in favor of the client. No appeal was taken.
- Represented Halliburton, York International, Sony, St. Jude Medical, LG Electronics, Kay Chemical, Hyundai Welding, and Denver Instruments in district court litigations that were respectively successfully settled.
- Represented Halliburton, LG Electronics, Denver Instruments, and others before the U.S. Court of Appeals for the Federal Circuit.
- Served as a law clerk to the Honorable Francis Browne, in the Trial Division of the U.S. Court of Claims.
- Former patent examiner at the U.S. Patent and Trademark Office.
