Michael A. Morin

Partner

Mike Morin practices patent litigation at both the trial and appellate court levels. His cases have involved a wide range of technical subjects, including medical devices, software, pharmaceuticals, biologics, consumer products, amusement rides, and sporting goods.

Mr. Morin has extensive experience in all aspects of patent litigation. He frequently serves as lead counsel in patent infringement litigations and has extensive trial experience, including as a first-chair litigator. He regularly leads litigation teams in complex and significant patent infringement litigations. Mr. Morin's trial practice is complemented by his experience before the U.S. Court of Appeals for the Federal Circuit, where he has argued on multiple occasions.

In addition to his litigation practice, Mr. Morin advises clients regarding their intellectual property portfolios and strategies, assists with licensing issues, and renders opinions advising clients of their legal positions and responsibilities. Mr. Morin devotes substantial time to pro bono activities, representing disabled veterans in civil matters and indigent defendants in criminal cases.

Mr. Morin lectures frequently on litigation matters. He is on the faculty of the Trial Advocacy College at the University of Virginia, where he teaches trial skills to attorneys from throughout the country. And he teaches frequently for the Patent Resources Group, focusing on issues relating to opinions of counsel and their pertinence to patent infringement litigation. Mr. Morin has taught U.S. patent infringement courses for foreign practitioners throughout Europe and Asia, and has lectured at conferences hosted by the ABA, AIPLA, Ali-ABA, and PLI.

Highlights

  • Successful representation of Abbott in a series of litigations involving coronary stents; achieved summary judgment on competitor's patent and trade secret claims (affirmed by Federal Circuit) and obtained jury verdict of infringement that all of competitor's accused stents infringed Guidant’s patents.  Cases settled in exchange for $400 million payment to our client. 
  • Lead counsel for Abbott in arbitration regarding drug-eluting stent technology against one of its primary competitors: client won on all issues and recovered its attorney fees.
  • Lead counsel coordinating defense of Abbott's cardiovascular stent products in lawsuits pending in the Netherlands, Germany, the UK, and Ireland, as well as European Patent Office proceedings.
  • Centocor v. Abbott Labs (E.D. Tex., Fed. Cir.). Lead counsel for Abbott in arbitration regarding human anti-TNF antibodies against one of its primary competitors: client won on all issues.
  • Lead counsel for Acclarent, a leader in sinuplasty technology, in multiple litigations.
  • Elcommerce.com, Inc. v. SAP (E.D. Pa.). Lead counsel for SAP, a worldwide leader in business software, in patent infringement litigation relating to supply-chain software.
  • Lead counsel for Abbott in multiple patent litigations relating to its market-leading VISION™ bare-metal stent, market-leading XIENCE™ drug-eluting stent, market-leading HUMIRA® medication, and innovative STARCLOSE™ vessel closure system.
  • Lead counsel for ProSlide, a worldwide leader in waterslide technology, in multiple cases.
  • Continental Appliances, Inc. v. Copreci S Coop (C.D. Cal.). Lead counsel for Copreci and Mondragon in patent infringement litigation involving heating units.
  • Argued numerous pro bono cases at Federal Circuit for disabled veterans, and represents indigent defendants pro bono in criminal cases.
  • Serves as a member of the firm's management committee, 2009-present.
