Linda J. Thayer

Linda Thayer specializes in high tech patent and trade secret litigation, patent interferences, patent opinions, due diligence investigations in connection with investments, mergers and acquisitions, and worldwide patent portfolio development and management. She has litigation experience in both federal and state courts, and has acted as lead counsel in both patent litigations and interferences.

Her technical areas of expertise include computer hardware and software, computer security, watermarking, digital signatures, SSL, wireless communication devices and systems, networking, digital video, MPEG, data compression and storage, digital rights management (DRM), signals analysis, semiconductor devices and manufacturing equipment and processes, display devices, voice recognition, and the Internet. As a carryover from her prior industry experience, she is uniquely qualified in the areas of encryption and cryptography.

Ms. Thayer often speaks on software patents and digital signatures, due diligence, and patent law reform in both the U.S. Patent and Trademark Office and Congress.

Highlights

  • Lead counsel for Intertrust Technologies in two patent interferences and the subsequent appeal to the Northern District of California involving patents and applications relating to digital rights management. Obtained several successful judgments before Board of Patent Appeals and Interferences in favor of Intertrust, including a finding of inequitable conduct by opponent, resulting in favorable resolution. (Intertrust v. Macrovision).
  • Represented Winbond Electronics in multiple patent litigations in Northern District of California involving semiconductor chip technologies and products, such as non-volatile flash and EPROM memory. (Integrated Cir Sys v. Winbond Electronics, and Silicon Storage Technology, Inc. v. Winbond Electronics).
  • Defending Financial Fusion, Inc. and FedEx Corporate Services against claims of infringement by Ablaise, Inc. relating to online banking software and Internet website technology in ongoing patent infringement actions filed in the Northern District of California and the District of Columbia.
  • Defending Marvell Semiconductor, Inc. against claims of infringement by Wi-Lan, Inc. relating to wireless products adhering to the IEEE 802.11 standard in ongoing patent infringement actions filed in the Northern District of California and the Eastern District of Texas.
  • Manages several large worldwide patent portfolios.
  • For the National Security Agency, as a cryptologic mathematician, developed and exploited encryption algorithms and, as an advisor to the chief of operations of a joint civilian/military base in Germany, performed strategic planning and analyzed IT requirements for satellite. communications supporting U.S. and NATO Operations.
  • Served as a member of the Moscow Embassy evaluation team in 1987, during which time she examined partially constructed embassy buildings for evidence of electronic espionage devices.
  • Interned at the Center for Democracy and Technology, a non-profit organization concerned with privacy in global communications technologies, working on projects related to proposed new encryption export regulations.
