Ford Farabow has extensive experience in federal district and state court litigation throughout the country, domestic and foreign arbitrations, as well as mini-trials and other alternative dispute resolution processes. He has successfully tried jury and nonjury patent infringement cases for both patentees and for companies accused of infringement.

Mr. Farabow’s work as lead counsel in patent, trade secret, and licensing disputes has focused primarily on the technical fields of chemistry, pharmaceuticals, chemical engineering, and materials science, including, for example, polymers, polymer production processes, paper chemistry, packaging materials, metal alloys, steel products, glass compositions, diagnostic test materials, catheter products, and drug products.

At the appellate level, Mr. Farabow has handled and won numerous cases in the U.S. Court of Appeals for the Federal Circuit and other circuits.

Mr. Farabow routinely lectures and gives trial demonstrations to bar groups and to industry associations.

Highlights

  • Successfully defended Hercules, Inc. against charge of patent infringement by Ciba Specialty Chemicals in 2006 (water treatment chemicals). Won summary judgment of non-infringement and bench trial on privity issue in D. Delaware.
  • Won verdict and judgment of patent valid and infringed and lost profit damages for Cryovac, Inc. against Pechiney Plastic Packaging, Inc. in 2006 in D. Delaware (plastic packaging).
  • Currently representing AstraZeneca (drug product) and NOVA Chemicals Inc. (polymer products) as plaintiff and defendant, respectively, in patent infringement suits.
  • Worked in the patent departments of Swift & Co. and Hercules, Inc.
