Robert Bajefsky has more than 30 years of experience handling patent litigations involving biotechnology, pharmaceutical, and chemical issues. He represents clients at both the trial and appellate levels, and also counsels clients on pre- and post-trial strategy. He has rendered a broad array of validity, infringement, and enforceability opinions on patents related to biotechnology and pharmaceuticals. As outgrowths of litigations, he has also represented clients in reissue and reexamination proceedings before the U.S. Patent and Trademark Office.
Mr. Bajefsky has represented Fortune 500 companies, international industry leaders, as well as, smaller innovative businesses in lawsuits in federal district courts throughout the U.S., and has coordinated parallel litigations in various European countries. He has helped protect clients’ valuable interests in technologies ranging from recombinant pharmaceuticals such as human growth hormones and groundbreaking treatments for arthritis; research tool patents such as HIV protease inhibitor patents; and small molecules used to treat a wide range of diseases ranging from depression to hypertension to allergies.
Mr. Bajefsky has also defended clients’ interests in numerous Abbreviated New Drug Application (ANDA) litigations. He has also served as lead counsel in successful appeals to the U.S. Court of Appeals for the Federal Circuit, in which the court affirmed summary judgments obtained in the trial courts.
