Peterson Publ'g v. Blue Gravity Communications
2000 U.S. Dist. LEXIS 6959 (D.N.J. Jan. 6, 2000)
Plaintiff, owner of Teen Magazine, operated its website at “www.teenmag.com.” After receiving complaints about defendants’ “teenmagazine.com” website from teenage girls, plaintiff discovered that defendants’ site was taking visitors to pornography sites. Invoking the ACPA, plaintiff obtained a temporary restraining order enjoining defendants from using or transferring the “teenmagazine.com” domain name, and requiring defendants to immediately turn over the “teenmagazine.com” domain name to plaintiff pending the preliminary injunction hearing.
