Briefing has begun in Bilski v. Kappos, with oral arguments scheduled for November. Until the U.S. Supreme Court issues its decision, the scope of what can be patented in the United States remains uncertain. To try to limit this uncertainty, the USPTO has issued Interim Instructions to its examiners on how to examine claims for patent-eligible subject matter under 35 U.S.C. § 101.

Mike Jakes and Erika Arner, Bilski's Supreme Court counsel, will present an update on Bilski v. Kappos, including an overview of the positions taken in the over forty amicus curiae briefs filed so far. The panel, moderated by Bob Yoches, will also discuss the USPTO’s Interim Instructions on patentable subject matter, including tips for patent applicants and practitioners for navigating these uncertain times.
