On March 23, 2010, President Obama signed into law health insurance reform legislation, H.R. 3590, a bill which has generated enormous media coverage and publicity. Less publicized is the fact that a subtitle of H.R. 3590, the “Biologics Price Competition and Innovation Act of 2009,” created the legal and regulatory framework for the approval of follow-on biologics (“FOBs”). Some highlights of the legislation include:
Creation of biosimilarity and interchangeability standards for assessing FOB applications
An award of 12 years of data exclusivity for innovator biologics
Creation of a patent information exchange regime prior to FOB patent litigation
This webinar will address the finer points of the proposed legislation and provide the audience with useful tips for prosecuting patent applications directed to biologics, navigating the new specialized patent litigation framework for biologics that differs from ANDA litigation developed under the Hatch-Waxman Act over the past 25 years, and analyzing the patent portfolios covering marketed biologics.
