Finnegan’s IP Update will focus on key IP developments and strategies in-house counsel can use.
Days after the scheduled Supreme Court oral arguments in the Bilski case on what can be patented—Finnegan’s J. Michael Jakes, who will be arguing the case on behalf of Bilski, will discuss the issues and the Supreme Court’s questions.
We also will look at Ariad, a biotechnology case in which the Federal Circuit will consider en banc whether a written description requirement for patents exists separate from an enablement requirement.
In the trademark area we will discuss the Second Circuit’s recent Rescuecom decision on trademarks as keyword triggers in Internet searches, and the new Trademark Trial and Appeal Board’s fraud standard. In the copyright area, our presentation will cover the Second Circuit’s Cablevision case regarding remote DVR services not infringing the content owner’s copyrights, and the Reed Elsevier case pending before the U.S. Supreme Court on the subject matter jurisdiction of federal courts. To round out the afternoon, we will consider important developments in implied licenses, illusory contracts, software licensing, and the Computer Fraud and Abuse Act.
