On November 20, 2015, the Patent Trial and Appeal Board (PTAB) ruled in favor of Finnegan client FedEx, invalidating IpVenture’s shipment-tracking patent. FedEx was able to prove by a preponderance of evidence that claims 1-30 of IpVenture’s ‘165 were unpatentable. The decision came three years after the U.S. Patent and Trademark Office granted FedEx’s request for reexamination of a related patent that IpVenture claimed FedEx infringed. In September, the PTAB rejected all of IpVenture’s claims in that inter partes reexamination.
