This article discusses the new patent reform bill, S.23, which marks the fourth attempt at comprehensive patent reform in the last six years. The bill is expected to meet the same opposition as it’s predecessors as it makes its way through Congress.
Rebecca McNeill, attorney at Finnegan, expressed her concerns as well as optimism for the proposed legislation. “I am excited about the opportunity for post-grant review as an avenue for challenging a patent at a lower costs, and it could increase certainly in the validity of challenged patents,” she told BNA, “but I have concern of how it will be implemented and woven into the agency’s current procedures.”
