Cortney S. Alexander

Cortney Alexander focuses on patent litigation, primarily concerning the enforcement of patent rights in U.S. district courts and before the U.S. International Trade Commission (ITC). His litigation experience includes arguing claim-construction hearings, conducting and defending depositions, and coordinating expert discovery.

In addition to his litigation practice, Mr. Alexander also maintains a strategic patent prosecution practice, including arguing before the Board of Patent Appeals and Interferences of the U.S. Patent and Trademark Office (USPTO). In addition, he provides counseling to clients on intellectual property issues by providing them with infringement, validity, enforceability, and clearance opinions.

Mr. Alexander technical background is focused primarily in the electrical, biomedical, and mechanical arts. Specifically, he has assisted clients in the fields of surgical and medical devices, computer processors, e-commerce software, computer networking, semiconductor packaging, prosthetic implants, and artificial playing surfaces.

Mr. Alexander maintains an active pro bono practice, and often represents military veterans before the U.S. Court of Appeals for Veterans Claims. He also provided pro bono legal services to a home for abused, neglected and abandoned children in the custody of the state.

Highlights

  • Interval Licensing LLC v. AOL Inc. (W.D. Wa.). Represent defendant in infringement action brought by Paul Allen's licensing company asserting four patents against 70 accused products.
  • General Electric Co. v. Mitsubishi Heavy Indus., Inc. (N.D. Tex.). Represent defendant in infringement action seeking to block defendant from the U.S. wind turbine market.
  • Hutchinson S.A. v. Accuride Corp. (D.N.J.). Obtained pre-discovery grant of summary judgment of no liability for infringement on behalf of defendant supplying government contractor.
  • Rambus Inc. v. nVidia Corp. (ITC). Represented patent owner in ITC action for infringement of patents directed to memory controllers, resulting in finding of infringement.
  • Video Enhancement Solutions LLC v. Research In Motion, Inc. (C.D. Cal.). Represented defendant in patent litigation involving smart phones.
  • Argued a Markman hearing on behalf of defendant that resulted in favorable construction of means-plus-function term, leading to patentee's voluntary dismissal of infringement claim.
