On July 19, 2016, a judge in Delaware’s federal district court ruled in favor of Finnegan client Under Armour Inc. against digital health company Healthbox Global Partners LLC (HGP) in a recent trademark infringement case. The judge denied HGP’s request for a preliminary injunction against Under Armour because the plaintiff failed to demonstrate a likelihood of success on the merits of its claims, including for trademark infringement, unfair competition, and trademark dilution, pertaining to Under Armour’s connected-fitness products under its HEALTHBOX/UA HEALTHBOX mark and HGP’s federally registered HEALTHBOX mark and name.
In August 2016, HGP dropped the lawsuit.
