The issue of non-traditional trademarks is explored in May’s edition of Intellectual Property Magazine. The article compares non-traditional trademarks against traditional and also registered designs, all three of which have different levels of legal protection and lifespan. Mark Sommers, partner at Finnegan, offers insight into the patent process as well as advice to those applying for a non-traditional mark. “The best practice is to do your homework,” says Sommers. “Glaring deficiencies based on inadequate past efforts cannot be cured after the fact. So, be proactive, not reactive.”
