The Defend Trade Secrets Act was enacted on May 11, 2016, in response to growing concerns about trade secret misappropriation in the United States (U.S.). This new federal act establishes a private civil cause of action for trade secret misappropriation, enabling victims of trade secret misappropriation to pursue an injunction and damages in federal court. The act also increases criminal penalties for those convicted of foreign economic espionage or trade secret theft.
