The speakers will discuss:
Recent decisions from the United States Supreme Court and Court of Appeals for the Federal Circuit have touched on a number of issues critical to patent litigation in the United States. The Supreme Court has recently clarified the issue of induced infringement, and the Federal Circuit has spoken on the issues of damages and inequitable conduct. The courts have repeated a constant theme, however, which is that parties having the burden of proof on an issue must provide clearer and more directed evidence.
This program examines these recent cases, and explains how parties can use them in litigation and business planning. The analysis will also explain the trends in these cases, and how they may affect other issues.
