Kenneth J. Meyers

Kenneth Meyers specializes in biotechnology and pharmaceutical patent matters and renders opinions on infringement and validity of United States patents. In addition, he counsels clients in licensing and technology transfer, including negotiating and drafting patent license agreements, confidentiality agreements, employment and consulting agreements, and joint venture agreements. His practice also includes counseling nonprofit research institutions in patent matters. For the past 25 years, he has served as a lead attorney handling interference proceedings at the U.S. Patent and Trademark Office, and has been involved in over 60 interferences during this period of time.

In the early stages of his career Mr. Meyers was primarily engaged in the preparation and prosecution of U.S. and foreign patent applications in the dyestuff, polymer, and glass and ceramic fields. Subsequently, his practice focused on pharmaceutical technology. In the mid-1980s, he took additional course studies in the biotechnology field, including molecular biology, immunology, cell biochemistry, genetic engineering, and biochemical engineering. He lectures and writes on topics of patent interference practice and the procurement of patent protection on biotechnology inventions.

Highlights

  • Briefed and argued a successful appeal before the Court of Customs and Patent Appeals in the case, In re Bayer, which dealt with the meaning of the expression “printed publication” in Section 102 of the U.S. patent law.
  • Worked for E.I. duPont de Nemours & Company in Washington, D.C., where he was engaged in the preparation and prosecution of patent applications in the field of polymer chemistry.
