ITC Affirms Loss for O2 in Display Patent Case

July 19, 2010

Law360

The U.S. International Trade Commission (ITC) dealt a blow to power management systems company O2 Micro International Ltd., agreeing with a judge's finding that no Section 337 violation had occurred regarding O2's patent for backlighting technology for liquid crystal displays. The commission agreed Monday, on slightly different grounds, with Administrative Law Judge James Gildea's findings that respondents Monolithic Power Systems Inc. and its customer ASUS Computer International did not infringe on the patent-in-suit. However, the commission went even further by disagreeing in part with Judge Gildea and reversing his finding that two products made by the only other remaining respondent in the case, Microsemi Corp., did infringe U.S. Patent Number 7,417,382, according to the commission's heavily redacted order. ASUS was represented by Finnegan.
