WASHINGTON, DC -On April 28, 2011, the U.S. Court of Appeals for the Federal Circuit reversed the U.S. International Trade Commission’s claim construction of U.S. Patent No. 5,470,257 (entitled “Radial Compression Type Coaxial Cable End Connector”) and its related finding that the Complainant had not established the technical prong of the domestic industry requirement of Section 337. In its opinion, the Federal Circuit held that the Complainant, our client John Mezzalingua Associates, Inc. (d/b/a PPC, Inc.), had established a Section 337 violation (importation, infringement, validity, and domestic industry) and remanded to the ITC for further findings on remedy and bonding.
