Daniel Chung represents clients ranging from startup companies to multinational corporations in complex intellectual property (IP) litigation and strategic IP counseling. He focuses on litigating patent and trade secret disputes before U.S. district courts, the U.S. International Trade Commission (ITC), and arbitration panels. Daniel’s leading work has been recognized by several publications, including The National Law Journal (NLJ) and Legal 500 U.S. He currently co-leads the firm’s Sports, Fitness, and Outdoor Recreation industry group.
Daniel’s experience serving as lead counsel as well as supervising numerous teams in resolving IP disputes crosses all phases of IP litigation, from pre-suit investigations through trial and appeal. He manages fact and expert discovery, drafts and argues motions and legal briefs in court, examines fact and expert witnesses in jury and bench trials, and handles pre-trial and post-trial proceedings. Daniel also prepares and briefs appellate arguments before the U.S. Court of Appeals for the Federal Circuit (CAFC) and represents clients in post-grant proceedings before the Patent Trial and Appeal Board (PTAB) of the U.S. Patent and Trademark Office (USPTO).
His work encompasses a wide array of technologies, including consumer electronics, consumer health products, medical devices, sports and fitness equipment, artificial intelligence (AI) software, and semiconductors. Daniel also represents clients in patent matters related to industry standards, such as IEEE 802.X and various mobile communications as well as TV standards, and in disputes involving standard essential patents (SEPs) and fair, reasonable, and non-discriminatory (FRAND) issues.
In his strategic counseling practice, Daniel assists clients in developing global IP portfolios and analyzing IP-related risks and opportunities. He evaluates competitor products and patents and prepares infringement, validity, freedom-to-operate (FTO), and patentability opinions. Daniel has considerable experience conducting due diligence investigations during potential investment and acquisition opportunities; drafting and advising on licensing agreements; and managing large global patent portfolios.
Prior to joining Finnegan, Daniel worked under the Department of Biomedical Engineering and the Department of Materials Science and Engineering at the Johns Hopkins University, where he helped develop a microcapsule-containing stent for cellular therapy and studied scaffold technologies involving protein hydrogels.
