Cephalon has filed a patent infringement suit against Lupin Pharmaceuticals to keep Lupin’s generic version of popular narcolepsy and sleep apnea drug Nuvigil® off the market. The suit claims Lupin, which recently filed an abbreviated new drug application to market generic Nuvigil®, will infringe two of Cephalon’s patents if it moves forward with its generic. Cephalon has exercised a vigorous patent protection strategy for Nuvigil® and is represented in this matter by Finnegan.
