Management of intangible rights is increasingly a headache for general counsel. It doesn’t take long for companies to run up hundreds of thousands of dollars a year in government fees for developing, filing and maintaining their patents. What budget is appropriate? How is the GC to know if the budget is used wisely or squandered on patents that ultimately will not add perceptible investor value? And how is one to know whether best practices are in place to ensure that important IP is not lost?
And as modern interface with consumers and end users increasingly allows the collection, retention, use and transfer of sensitive and highly valuable information, all in the click of a button: are sufficient protections in place to ensure a company’s rights and obligations in such important information. Does the company adequately monitor incoming and outgoing data? And what are the key questions that GC’s should ask?
In this roundtable, Finnegan’s Gerson Panitch, who has set up internal patent programs for many Israeli and international companies, will outline best IP policies and practices from a GC perspective. Similarly, GKH’s Adi Gillat who counsels many companies on data protection and privacy compliance, will focus on the management data—from customer-collected data to the data collected from security cameras in the parking lot.
