Shah offers commentary on what technology transfer offices should know as key provisions of the America Invents Act (AIA) take effect on March 16, 2013. Shah notes that transfer offices should “be careful about using new language not already present in the specification. If a new matter rejection is issued for a pre-AIA application, it is unclear what effect that rejection will have on the applicability of the new AIA rules.”
