Recent decisions from the U.S. Court of Appeals for the Federal Circuit and the U.S. Supreme Court have changed long-standing principles of patent law. These cases have raised many questions, including what non-infringement defenses are available and how to litigate them after the Akamai and McKesson decisions. Patentees also have to re-think how they prosecute patents or amend pending claims to strengthen their enforcement values. Many patentees also now have to reconsider what inventions are patentable in light of recent decisions like Prometheus and CLS Bank Int’l.
