Finnegan’s Shanghai Office cordially invites you to attend the next event of its exclusive Advanced Intellectual Property Seminar Program series featuring Finnegan attorneys Elizabeth Niemeyer, Ningling Wang, and Dr. Maximilienne Giannelli who will discuss the key strategies and actions that can help lead to victory, including discussing a recent victory at the ITC for a top exporter of specialty chemicals in China against an aggressive, large U.S.-based patentee.
Patent litigation in the United States can pose unique challenges for foreign companies. This talk will address options and strategies for early case termination and will further provide an overview of what companies need to know when litigating in the United States, including a discussion of common pitfalls in patent cases and the differences between ITC and district court litigation.
Many commentators have questioned the ongoing risk of being sued at the ITC, arguing that recent ITC and Federal Circuit decisions could reduce the number of cases filed there. This talk will dispel those myths by presenting facts related to the ITC’s continued popularity and the limited impact of these recent decisions.
Next, this presentation will provide an overview of recent and upcoming landmark cases from the Federal Circuit Court of Appeals addressing the ITC’s authority, including the ITC’s authority to investigate trade secret cases, enforce consent orders, and issue exclusion orders based on theories of indirect infringement. This talk will further address new litigation strategies in view of those decisions.
Finally, this talk will conclude with practical considerations related to making discovery more efficient and less burdensome.
