$1M Fees Award Nixed in Leviton’s Shock Guard IP

A federal appeals court has nixed a lower court ruling that Leviton Manufacturing Co. Inc. committed inequitable conduct during the prosecution of a patent for a device to protect against electric shocks, nixing an award of $1 million in costs and attorney’s fees to defendant Shanghai Meihao Electric Inc. The U.S. Court of Appeals for the Federal Circuit found that there were issues of material fact that precluded a lower court judge from granting summary judgment of inequitable conduct. Leviton is represented in this matter by Finnegan.
